Please read the Terms and Conditions of this Customer Agreement carefully before you (the customer) make reservations and/or purchase a tour and/or tour-related products listed on westwindoutdoors.com or our travel services site. This agreement with help you completely understand the rights and responsibilities of both yourself and Westwind Outdoors LLC. By becoming a westwindoutdoors.com customer, you agree that you have read, understand and agree with the following Terms and Conditions, and give irrevocable consent to be bound by all said Terms and Conditions, including any updates thereto. Westwind Outdoors LLC has the right to change the Terms and Conditions, in whole or in part, at any time with or without notice. Westwind Outdoors LLC encourages you to print out a copy of this agreement to review and bring it with you on your trip.

Once you register you’ll receive further details on what exactly you need to bring, along with a detailed itinerary and everything you need to know for this trip. Reserve your place here today (15 seats is going to go pretty fast!) and get ready for a great adventure!

By paying your deposit you are agreeing to the following terms and conditions:

Included and Not Included: Please read the itinerary page for your trip completely to see what is and is not included on your trip.

NOT INCLUDED: Airline flights (international / domestic) and your transfer fees to/from the local airport where the trip begins, airport transfers to our first night hotel meeting place (unless indicated in the itinerary), gratuities unless mentioned in the tour description, any meals or extras not indicated in the itinerary purchased (alcohol, drinks, snack bar, phone calls, laundry, etc.) at the hotel (you will be required to give the hotel a credit card when you check in for any possible extras). Equipment – you must bring your own camera and accessories (e.g., memory cards, tripod, etc.). You will also need to get your own travel and health insurance. In some countries you may need to get and pay for a VISA certificate from the country you are entering. (we provide info to help you). You should also check with your doctor before entering a country about any immunizations you may need or update.

​Rates: Rates are per person in US dollars, based on double occupancy and subject to change without prior notice. Solo travelers may request to be matched up with same sex roommates. Private rooms are available on some trips but based on availability and upon paying a single supplement. Rates are subject to change without notice. 

Restrictions:
• There must be no more than 4 adults per room.
• Adults only 18 and over per room without consent of Westwind Outdoors LLC.

  Minors under 18 must be accompanied by a responsible adult.
• No pets are allowed

Minimum of 6 guests required to run most trips / Max of 15 guests on most trips unless stated on the Itinerary. If we must cancel this trip all money you sent for this trip will be refunded within 30 days of cancellation.

Airlines: You should NOT make your flight reservations until you have written confirmation from us that the trip has enough people to go. Transportation (international / domestic) and your transfer fees to/from the local airport where the trip begins are not included in the trip price as our guests come from all over the world.

Activity Level: Unless otherwise stated in the trip itinerary most of our trips are rated moderate as we may be out and about every day walking, hiking, and other outdoor activities often on uneven terrain, there may be stairs, getting in and out of all kinds of transportation, boats, ships, planes, trains and vehicles, etc. If you have a handicap or mobility issue please advise us before the trip and bring a dedicated person to assist you as the trip leader will be responsible for the entire group of people and we do not want to jeopardize the ability of other trip members to enjoy their trip.  

Acceptance of Risks: Travel involves a certain degree of risk. Such risks may include amongst others, injury, disease, accident, loss of property, inconvenience, delays, discomfort and even death. Please understand that you must accept these potential hazards as part of traveling. Westwind Outdoors LLC will not be liable for any such risks or claims beyond the money paid for the trip. Westwind Outdoors LLC will also not be liable for the consequences of terrorist activity, strikes, industrial action, wars, civil strife, road closures, construction, adverse weather conditions, natural disasters, actions of other participants on the trip or any other untoward occurrences or any uninsured losses of your property. If you are concerned about any of these issues we highly recommend you purchase trip insurance. 


Trip Insurance: Life happens...If you're worried about cancelling or problems during the trip, please purchase trip insurance. You might check out Travel Insurance.

You are required to get travel insurance and health insurance to cover any and all travel problems on our international trips that you may encounter. 

Add'l Discount: You may qualify for additional discounts on this event if you’ve purchased trips from us in the past.

Trip Cancelled: I understand and acknowledge what might happen in the unlikely event that Westwind Outdoors needs to cancel YOUR trip for any reason... In the event we are forced to cancel your trip for reasons beyond our control (minimum number of people not met, natural disasters/ civil unrest/"force majeure") we will offer you the choice of a refund or an alternative trip. We will accept no liability for any costs incurred by you for anything other than the monies paid to us for the trip.
If we are unable to get enough participants by a certain cutoff date we will refund all the money you have paid us.

Itinerary changes: We reserve the right without penalty to modify, change, substitute to the best of our ability or eliminate part of the itinerary or explorations if it becomes necessary in order to protect the well-being and safety of the travelers. Our trip schedules are always subject to change due to weather, construction, closure or cancellation from vendor, natural disaster, problems out of our control with vendors and suppliers, and other unpredictable events. The primary focus of this group trip is on travel and photography and areas that are good for taking travel photos. While Westwind Outdoors LLC will make every reasonable effort to adhere to our itinerary, it is important to note that the nature of adventure travel and/or photo trips may require changes in travel plans. We reserve the option to try, when possible, to replace the activity with something else of interest but I understand and accept there will be no refunds of any portion of my monies due to changes in itinerary.

Trip Member Responsibilities:  I understand and accept that if I jeopardize the safety or well-being of the group, individual participants, trip vendor, myself or anyone else, that the trip leader will act in the best interests of the group to ensure that the trip runs as smoothly as possible. This action may be due to, but not limited to the following behaviors; excessive use of alcohol or any use or distribution of illegal drugs, use of any prescription drug use that impairs an individual, bullying, verbal, confrontational, physical or sexual abuse/harrasment, words or actions. We also do not allow smoking around the group. We expect consideration of fellow travelers and awareness of the group travel schedule, please do not delay the group for activities and meetups. We also have an "accepting of diversity" policy. Lack of respect in any way for diverse religious, cultural, sexual, racial, ethnic, political, etc. differences is not tolerated. You are 100% responsible for paying for any damages made by an accident to your room, any vehicles we travel in, or any other damage to participants property or vendors property.


Medical Conditions, Pregnancy and Travel: If you have a medical condition, or if you are pregnant and considering travel, you must consult with your doctor before you travel, especially if your medical condition requires daily routine care, urgent care, or your pregnancy is high-risk. You are responsible for disclosing any related information to us during the check-out process by adding special comments. You are 100% responsible for making sure you are fit enough to participate in this group trip. Most of our trips have a good amount of activity involved.  If you have any concerns about your fitness or health please check with your doctor before purchasing this group trip. We will be doing a lot of walking, hiking, etc often on uneven surfaces, there may be stairs to climb, we may be getting in and out of all sorts of transportation (boats, planes, trucks, vans, buses, etc). and if you are unable to efficiently enter and exit your accomodations or any other activity independently without assistance or causing delays to our schedule and inconvenience to other trip members our trips are not good trips for you. You understand Westwind Outdoors LLC and our local providers are not in a position to provide any medical services (beyond simple first aid) or urgent care in the event such an action may be required. You are 100% liable for any risks, incidences or consequences incurred during travel. We highly recommend that you purchase medical insurance and travel insurance before you travel.The trip leader has the authority to ask any participant to leave the group without a refund for any reason. Please advise us if you have any dietary restrictions, medical conditions or allergies. We will do the best we can to help make sure you have a safe trip. However Westwind Outdoors LLC will not be liable for any such risks or claims due to diet, health, medical conditions or allergies. Be sure to bring any medications you may need and please advise the trip leader if you are taking any prescription medications, just so we are aware of what is going on with you. We highly recommend that you purchase medical insurance and travel insurance before you travel. 


Roommates: Our prices are based on double occupancy. On some trips private rooms are available based on availability. If you are a solo traveler and would like to save money we can sometimes help arrange a roommate of the same sex. Roommates are expected to treat each other with consideration and respect as well as keep their belongings neat and organized in the bath area and general area to keep peace in the room. In the event that you and your roommate encounter problems or simply cannot get along please contact the trip leader. The trip leader may elect to ask the other trip members if anyone wants to voluntarily switch rooms. If no one wants to switch and if a single room is available (NOTE: Some locations, (IE ships, safari camps etc.) may be small, filled up and/or may not have enough rooms to accomodate the scenario (rooms, tents, cabins, lodges, etc.) you can both opt to pay a single supplement (to be quoted) for all remaining places we stay in, opt to continue to room together or leave the trip with no refund of any monies at your expense. Trip members who switch rooms on their own accord must notify trip leaders so we know where to contact/reach you at all times.

Regarding Hookups: Love at first sight? Hey, it happens, and here is where it gets complicated. Our policy is that if you are consenting adults it is not our business. However, what does concern us are the other original roommate(s) who are affected. The rules are (on a case by case basis): The involved party members may NOT displace their original roommate or place them in an uncomfortable situation in that original room. You may not have relations in that original room or the trip leader may ask you to leave the trip. First priority for the original room goes to the original roommate. The party members who want a consenting adult romantic liason must request a different room at their own expense. They will also be charged for the single supplement of the roommate (for all remaining days on the trip) they are leaving in the case that there are no other available and willing roommates for them. Trip leaders must be notified of any room changes so we know where to contact/reach you at all times.(NOTE: Some locations may be small, filled up and/or may not have enough rooms to accomodate the scenario (rooms, tents, cabins, lodges, etc.) in that case you may choose to leave the trip with no refund of any monies at your expense OR simply wait to meetup after your trip is over.

Immunizations:  You should also check with your doctor before entering a country about any immunizations you may need or update.

Diversity: We also have an "accepting of diversity" policy. Lack of respect in any way for diverse races, religious, cultural, sexual, ethnic, political, etc. differences is not tolerated. Our policy is simply to "Have respect". The trip leader has the authority to give a warning and then ask any participant to leave the group without a refund.

Language: This is an American based company. Please respect that we speak English and our exceptional local suppliers will speak English (may be bilingual). If you are unable to speak English we strongly suggest you travel with a fluent English speaking/reading/writing translator. Note you will need to be very aware of and not disturb other guests on your trip during translating.

Smoking: We are a non-smoking company. If you feel the need to smoke please do so in private well away from the rest of the group, smoking is not allowed in any of the accomodations or bathrooms, around our modes of transportation & vehicles at all times.

Emergency Info: We will be sending more information to you about the trip. We will also ask that you provide an emergency contact for us in the event of an unforseen occurance.

Model Release Photography and/or videography: You will be asked to sign a model release during this trip for promotional or commercial use of Westwind Outdoors LLC and their vendors.

Background Check: We reserve the right to perform or not perform a background check on any potential guests who want to go on our trips. Westwind Graphics LLC is not liable for anyone who joins who proves to be dangerous, is a felon or criminal. You are required to get travel insurance and carry your own health insurance to cover any travel problems you may encounter including dangerous people. The trip leader has the authority to call the police and ask any participant to leave the group without a refund. 

Privacy: Your Privacy is very important to us. We will not sell or give your personal information to anyone except vendors we are utilizing for the trip or officials such as police or medical in case of emergencies. If you want another trip member to know your contact info you will have to give it to them.

VISA's: You may need to get and pay for a VISA certificate from any country you are entering. (we provide info to help you). Some countries take several weeks to process these so we encourage you to get these as soon as you make your flight reservations. DO NOT make your flight reservations until you have written confirmation from us that the trip has enough people to go.



 
CANCELLATION POLICY 
• Your purchase does not automatically guarantee a reservation. Your purchase will be confirmed via email within one to two business days. The cancellation fee policy will take effect once you submit your reservation. If your purchase cannot be confirmed for any reason, we will fully refund your purchase without any additional charges. We recommend each customer read and review the cancellation policy and consider purchasing a Travel Insurance policy.

What CAN be Refunded:
• Some tours may require a minimum number of guests to operate. The affected guest will be fully refunded or may choose a similar tour product as a substitute if available. Should this occur, it would be under very rare circumstances because we try our best to accommodate guests.
• Please note that the product substitute chosen by the guest may be more expensive than the original product and therefore may be subject to an additional cost.
• Any additional refunds based on extenuating circumstances will depend on our vendor/ individual tour operator.


What CANNOT be Refunded:
• All hotel and tour schedules are arranged ahead of time. Any guest failing to appear on the day of departure will not be refunded.
• No refund will be given for any portions of the tour unused by the guest after tour departure regardless of circumstances.
• Airfare is completely non-refundable and non-changeable for tours when airfare is included in the final price.
• Hotel extensions and Instant Confirmation products (admission tickets, city passes, etc.) cannot be exchanged or refunded once confirmed.

The Cancellation Policies listed below apply to all reservations unless the tour booked has specific rates or fees listed under "Special Notes." Please carefully review the "Special Notes" of your tour prior to booking. Please know that Westwind Outdoors LLC will always adhere to our tour vendors individual tour policies when applicable.

• Please note that cancellation fees are calculated based on the date Westwind Outdoors LLC and our vendors receives your signed Cancellation Request Form and travel service start date.
• If a tour is scheduled to depart within the next 7 days, Westwind Outdoors LLC and our vendors will not change a guest's departure date and will not offer a refund.
• All cancellations must be made directly with Westwind Outdoors LLC, not with tour operators or vendors.
• In most cases, reservations paid by wire transfer, cash deposit, or money order/traveler's check/cashier's check will be refunded via PayPal or check. For refunds processed by wire transfer, any associated wire transfer fee will be deducted from the overall refund amount.


How to Cancel a Reservation

  • Westwind Outdoors LLC and our vendors will NOT acknowledge any verbal / over-the-phone request or voice mail.
  • Verbally speaking with Westwind Outdoors LLC and our vendors customer service representatives without filling out a request form will not guarantee that your cancellation has been processed or acknowledged. Westwind Outdoors LLC and our vendors will NOT accept email cancellations unless they have a complete, signed, and attached Cancellation Request Form.
  • Cancellation must be made by filling out and signing the Westwind Outdoors LLC Cancellation Request Form. Please explain why you are requesting a cancellation. Please request the cancellation form via email at westwindoutdoors@aol.com.

  • Amendment Fees:
Any changes made to a reservation after successfully submitting the order online will be subject to a minimum $30.00 Amendment Fee (per change). Reservations will be confirmed within one to two business days. The following constitute as an amendment to a tour:
• Changing departure date
• Changing pick up time or location
• Changing tour
• Changing guest name
• Changing itinerary
• Removing / Replacing a guest
• Adding / Replacing a guest
• The $30.00 amendment fee is a minimum tour change fee. If you request multiple changes and/or request the adjustments at the last minute, additional fees may apply (in addition to the $30.00 amendment fee). Paying the $30.00 amendment fee does not guarantee a change can or will be made.


Disabilities and Travel
We embrace all people, regardless of colors or physical conditions. One of our goals is to provide free access and expand travel opportunities for people with special needs in the United States and abroad. We are exploring more travel products to accommodate this special population; however, yet, not all the travel products we currently offer include special accommodations or allow service pets. You are responsible to verify with us before you book travel to ensure that special arrangement can be made if it is required for your needs. Westwnid Outdoors LLC and/or local vendors are not liable for any incidences or consequences incurred during travel or complaints or lawsuits during or after travel due to your failure to inform us of your special needs. You also have the responsibility to re-confirm with us, after we reserve seats for you, that special accommodation will be provided per your request.


Travel companion
All travel companions parties agree to take the tour together on their own will and accord. Disparities financially, culturally, or personally are each party's responsibility to resolve and must not affect the overall tour in any fashion. If one party cancels their part of the tour, all additional penalties or charges associated with the cancellation of the departing party's tour must be paid by the departing party in full. This ensures the departing party leaves the attending parties and their tour in good standing. 

Chargeback
You hereby waive any objection you may have to Westwind Outdoors LLC's use of electronic records with Paypal, Discover, MasterCard, Visa, American Express or banks that issue credit cards should it be necessary for Westwind Outdoors LLC or our travel vendors to respond to a chargeback. You agree that Westwind Outdoors LLC or our travel vendors does business electronically by email, so email is accepted as the form of delivery of the services provided by Westwind Outdoors LLC. You are not ordering tickets to be delivered in person or by mail, so you agree to accept email as the form of delivery and instructs Discover, MasterCard, Visa, American Express and banks that issue credit cards that email delivery constitutes delivery of services in this transaction. You agree not to dispute a credit card charge on the basis of services not rendered if Westwind Outdoors LLC or our travel vendors can prove that the E-Ticket was sent by email (by providing electronic proof that the E-Ticket was sent at a specific date and time as recorded by Westwind Outdoors LLC's or our travel vendors computer system or by mail (by providing a signed statement by the person who deposited the E-Ticket in the United States Postal Service). You agree that you will not dispute any charge improperly. This includes filing chargebacks claiming fraud if you claim the name of Westwind Outdoors LLC or our travel vendors was not recognized by you. In the event you file a chargeback improperly, you agree to provide a written statement to the credit card company confirming the charge is correct and should be paid and agree to send a faxed copy of this letter to Westwind Outdoors LLC's  Attention: Chargeback
In the event legal action is necessary for by Westwind Outdoors LLC's or our travel vendors to collect money taken away from Westwind Outdoors LLC's or our travel vendors through a chargeback or to collect the Chargeback Fee, you agree to pay Westwind Outdoors LLC's legal expenses if Westwind Outdoors LLC' wins the lawsuit.


Disclaimer and Limitation of Liability
Westwind Outdoors LLC and our local vendors uses reasonable efforts to have accurate, complete and current information on its website. However, since travel and tour rates are constantly changing, we do not warrant that all information is up-to-date or free of technical or typographical errors, errors or ommissions. It is the user's responsibility to verify any information before relying on it. We reserve the right to make changes and updates to any information contained within this site without prior notice. Access to, and use of, this website and the content thereof is at the risk of the user. In certain instances, we have provided links to other websites solely for your convenience. These sites are not maintained or controlled by Westwnid Outdoors LLC and we are not responsible for their content. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, bugs, worms, cancelbots, Trojan horses and other items of a harmful or destructive nature.
If your contact information, including but not limited to, your email address, phone number, physical address or other data is incorrect, Westwind Outdoors LLC and/or local vendors will not assume any liability for information not received by the customer/consumer.


Choice of Law, Waiver, and Claims
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado,  without reference to conflicts of law rules. As a condition of the use of the Westwind Outdoors LLC website and service, you (the Customer) agree to submit to the personal and exclusive jurisdiction of the courts located within the County of Larimer, CO 
and therefore agree to file any grievance or suit of any kind exclusively in the courts located within Larimer County, CO. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. Westwind Outdoors LLC's failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between Westwind Outdoors LLC or our vendors, tour operators, travel service providers and the product providers or between Westwind Outdoors LLC and any other of its Corporate Partners. Neither the product providers nor any Corporate Partner shall have the ability to create any obligation on Westwind Outdoors LLC's behalf. This Agreement constitutes the entire agreement between you and Westwind Outdoors LLC with respect to the use of WestwindOutdoors.com.
